An Australian Senate Committee has been informed by the Australian Government (AGS) that the previous Labour Government, headed by Kevin Rudd, had warned that proposed resources (RSPT) super profits tax could be unconstitutional solicitor.
It has been disclosed AGS informed the Board that government?s introduce the RSPT mining sector can facing opposition before the high Cour.Les grounds for such a request could be that he could have discrimination between States Australia, allowing credits or unequal tax refunds to be applicable to the same resource mining in different States.
It is believed that AGS have proposed amendments to the RSPT in some respects.However, Gillard new Government then, in July of this year, replaced the RSPT with a new mineral resource rent tax (LCSA), only apply ore and coal and it is not known now what measures the Government may have taken to overcome the constitutional challenges of iron.
However, a Government spokesman said the LCSA will be consistent with the constitution and they take important legal advice in the development of the relevant legislation.
